Provisional Assessment: Excess Excise Duty Must Be Adjusted – Rajasthan HC in Hindustan Zinc Case

Rajasthan High Court (DB) holds that on finalisation of provisional assessment the Department cannot split the financial year; excess excise duty paid must be adjusted against the alleged short-payment, though no cash refund or interest on excess is allowed.
