Sale obscene books and Obscenity near any public place is a criminal offense

अश्लील पुस्तकों, गानों, सी. डी आदि का विक्रय करना- किसी अश्लील पुस्तक, पुस्तिका, कागज, रंगचित्र, आकृति, या कोई अन्य वस्तु को अश्लील समझा जायेगा जो कामोद्दीपक है और कामुक वक्तियो के लिए रुचिकर है, ऐसी वस्तु को चाहे वो कुछ भी हो, बेचेगा, भाड़े पर देगा, लोक प्रदशित करेगा, वितरण करेगा, आयत निर्यात करेगा आदि, तो इस धारा के तहत अपराधी है I

प्रथम दोषसिद्धि पर दो वर्ष के लिए कारावास और 2000 रूपये का जुर्माना उसके बाद दोषसिद्धि पर पांच वर्ष के लिए कारावास और 5000 रूपये का जुर्माना

जमानतीय

उदाहरण-, व्यक्तियो को इंटरनेट के माध्यम  से व्हाट्सएप्प, फेसबुक पर अश्लील (जो यौन, यौन कृत्यों और नग्नता पर आधारित)  विडियो, टेक्स्ट, ऑडियो और सामग्री भेजना, और दुकानदार द्वारा एक अश्लील सी.डी की बिक्री करना आदि इस धारा के अंतर्गत अपराध है I

Sale obscene books, song, CD etc.- an obscene  book, pamphlet, paper, drawing, painting, figure or any other object, shall be obscene if it is lascivious or appeals to the prurient interest, and for purpose of sale, hire, distribution, public exhibition, import, export etc, which is criminal of this section.

First conviction- Imprisonment for 2 years and 2000.00 fine and Second conviction Imprisonment for 5 years and 5000.00 fine.

Bailable

Examples- Send obscene (Which is based on sex, sexual acts, and nudity) videos, texts, audio and content to people through the internet on what’s app or Facebook and selling a porn CD  by the shopkeeper etc. this is a crime under this section.

तरुण व्यक्तियो  अश्लील पुस्तकों, गाने, सी. डी आदि का विक्रय करना- जो कोई 20 वर्ष से कम आयु के व्यक्ति को अश्लील पुस्तक, पुस्तिका, कागज, रंगचित्र, आकृति, या कोई अन्य वस्तु को अश्लील समझा जायेगा जो कामोद्दीपक है और कामुक वक्तियो के लिए रुचिकर है, ऐसी वस्तु को चाहे वो कुछ भी हो, बेचेगा, भाड़े पर देगा, लोक प्रदशित करेगा, वितरण करेगा, आयत निर्यात करेगा तो इस धारा के तहत अपराधी है I

अपवाद-ऐसी पुस्तक, लेख, रेखाचित्र, आदि जिसका प्रकाशन   लोकहित के कारण न्यायोचित साबित हो गया है या जो धार्मिक प्रयोजन के लिए लिखी हो, प्राचीन स्मारक आदि I

Sale obscene books, song, cd etc. to young person- Whoever sells, let to hire, distributes, exhibits or circulates to any person under the age of twenty years an obscene  book, pamphlet, paper, drawing, painting, figure or any other object, shall be obscene if it is lascivious or appeals to the prurient interest, which is criminal of this section

First conviction- Imprisonment for 3 year and 2000.00 fine and Second conviction Imprisonment for 7 year and 5000.00 fine.

Exception-Such books, articles, sketches s, etc. that have been publicly proved due to the public interest or Written for religious purpose, ancient monument Etc.

अश्लील गाने, पवांड़े या शब्द गाएगा, सुनाएगा- लोक स्थान पर कोई अश्लील कार्य करना या कोई अश्लील गाने गाना, कोई  शब्द सुनना, सार्वजनिक स्थान पर गाली-गलोच तथा अश्लील शब्दो का प्रयोग करना, और शरीर का अभद्र प्रदशन, सम्भोग, इंटरनेट के माध्यम से अश्लील विडियो, टेक्स्ट, ऑडियो और सामग्री भेजना आदि I

3 माह के लिए कारावास या जुर्माना I

उदाहरण-  किसी लोक स्थान पर  ऑटो चालक द्वारा अपना  ऑटो दो लड़कियों के समीप खड़ा करना  और अन्य लोगो को या साथियो को कहना की आओ मेरी जान मेरे ऑटो में बैठो, में तुम्हे पंहुचा दूंगा, में तुम्हारा इंतजार कर रहा हु, इस तरह के शब्द इस धारा के अंतर्गत अपराध है I
